INTRODUCTION
The website www.chazette.fr (the “Website”) is an e-commerce information website accessible by Internet, open to any user of the Internet (“Webuser”). It is published by 4M Chazette-Spirit (“Chazette’Spirit”), a Limited Liability Company with registered capital of 6,425 euros, whose registered office is at 42 avenue Julien - 63000 Clermont-Ferrand - France, and is listed in the Clermont-Ferrand Trade and Companies Register under number 415 108 026.

The Website allows Chazette-Spirit to offer for sale various products sourced from Nature (“Products”) to Webusers browsing the Website (“Users”). A User who has placed an order is called a “Customer”. The rights and obligations of the User necessarily apply to the Customer.
The placing of an order for a Product offered on the Website implies that the User has read and accepted these General Terms of Sale including the withdrawal conditions, evidenced by ticking the box “I have read and accept the Chazette-Spirit General Terms of Sale and acknowledge that I have been informed of my right to withdraw. "

Article 1 - PURPOSE
The purpose of these General Terms of Sale (“Terms”) is to define, solely as they apply to the relationships established for Internet sales, the rights and obligations of the Parties arising from online sales of the Products offered on the Website.
They govern all the steps necessary for the placing of an order and subsequent processing of the sale between the Parties.
These Terms apply to the exclusion of all other documents.

Article 2 - PRODUCTS
2.1 Products
The Products offered for sale by Chazette-Spirit are those that appear on the Website, at the time that the User consults the Website, and stocks are subject to availability.
If any Product happens to be unavailable, the customer will be informed as promptly as possible.
Photographs and descriptions of Products are not contractual.

2.2 Protection of minors
Pursuant to Article L.3342-2 of the French Public Health Code which prohibits the sale of alcohol to minors, the buyer in filling in the order form confirms that he/she is at least 16 years of age as of the date of the order.

2.3 Alcohol consumption
Alcohol abuse is hazardous to health. Drink responsibly and in moderation.

2.4 Resale of Chazette-Spirit products
Chazette-Spirit products may not be resold without the written contractual agreement of 4M which owns the brand.
Chazette-Spirit products may not be repackaged under another brand name without the written consent of 4M.

Article 3 - PRICES
Prices are shown in euros and are valid for all European Union regions excluding Overseas Dependencies and Territories (“DOM-TOM”). They take into account any reductions as well as French VAT, applicable at the time of order. All orders placed on the Website and shipped to outside the European Union or to DOM-TOMs will be invoiced excluding VAT and may be subject to taxes, customs duties and other related charges levied when the package reaches its destination. Such costs apply in addition, and it is the Customer's responsibility to pay them.
The prices shown on the Website are guaranteed to be accurate at the time of order subject to stock availability, except in the case of typographical error or omission.
The prices shown do not include the cost of shipping, which will be added on top or waived depending on the amount of the order or the destination country, and will be clearly explained to the User upon final confirmation of the order.
Such shipping costs do not include customs duties or other related fees that may be required upon entry into certain countries, and it is the Customer's responsibility to pay them. Chazette-Spirit reserves the right, which the User accepts, to change prices at any time.
Chazette-Spirit also operates a loyalty scheme whose general terms and conditions are detailed at www.chazette.fr. In accepting the Chazette-Spirit General Terms of Sale, the Customer accepts the terms and conditions of the loyalty scheme.

ARTICLE 4 - SAVING AND CONFIRMING AN ORDER
4.1 Navigation within the Website
User may browse the Chazette-Spirit Website to see the Products offered on it.
User may browse any page of the Website without being required to place an order.

4.2 Saving an order
If User wishes to place an order, he may select any product and show his interest in it by clicking the “Basket” icon.
User may at any time:
- obtain a Summary of the Products that he has selected, by clicking on the basket.
- change his Product selection by clicking “Back to catalogue”.
- stop selecting Products and order them by clicking “Go to Checkout”.
To order the Products he has selected, after clicking “Go to Checkout” the User must identify himself by entering his email address and the password he chose when creating his account, or, if he does not yet have an account, by clicking “Create My Account”.
To create an account, User must accurately fill in the form presented which asks for the information needed to identify him, in particular his last name, first name, and postal address. User also has to enter his email address and a password of his choice which will be personal and confidential and which he will need to be able to identify himself on the Website in future.
User is notified and accepts that entering these two identifiers is proof of his identity and consent.
Once the User is identified, he will have to confirm the delivery address (as specified in Article 5 below), then an order form will appear on the screen showing the type, quantity and price of the Products in the Customer's basket, as well as the total amount of the order, shipping charge, delivery time, User's details, delivery address of the Products.
Promotions
To benefit from a promotional offer that he has received, User must enter and confirm his “promotion code” in the appropriate field, on the Order Summary page.

4.3 Final confirmation of order and payment
After User has reviewed his order and has entered all required information, a summary of that order and information will appear asking for User to select a payment method for final confirmation of the order.

Orders shall be payable in:

- euros by French or international credit card, French or European bank transfer, or French cheque..
- US dollars by credit card

In choosing to make an immediate payment by credit card the User will be automatically switched to the payment server of the secure electronic payment platform. This platform uses SSL (Secure Socket Layer) encryption to protect all payment-related data, and User's banking data is at no time shared with Chazette-Spirit information systems.
Once User confirms payment, the order is saved. User becomes Customer. The purchase order will be saved in Chazette-Spirit’s information system and will be considered proof of the contractual arrangement entered into by the Parties.
Under Article 6 below, the Customer has the right to withdraw and be refunded, for a period of 14 business days after receiving the Product.

4.4 Confirmation of Order
A summary of the order will be displayed once the order is confirmed.
This confirmation will show all the contractual details of the order entered into by the Parties.
This order summary will also be emailed to the Customer within ten minutes of purchase. Customer will then be able to “Track my order” by clicking “My Account” and identifying himself with his email address and password.

4.5 Modification of an order. Previous orders can be tracked from the “My Account” menu.
To make changes to an order, the order has to be cancelled, put back in the basket, and then corrected as necessary before confirming it.
An order cannot be changed or cancelled once its status is “Saved”. An order “In preparation” or “Shipped” is no longer modifiable.

Customer can send gifts to friends via the Website. The ordering procedure is the same as for making personal purchases. The Chazette-Spirit allows the Customer to send a personal message to the recipient of the gift. This message appears on the document that comes with the goods delivered.
Chazette-Spirit guarantees that the price of the offered item will not appear on the document that comes with the goods delivered.
The recipient of the gift will also be entitled to all the warranties specified in Article 6 below.

ARTICLE 5 - DELIVERY
5.1 Delivery terms and deadlines
Your orders will be processed as promptly as possible by Customer Service and by the Shipping Department, open Monday through Friday inclusive.
Orders will be prepared once payment is received; payment by credit card guarantees that your order will be processed quickly.
Shipping times in metropolitan France
Goods are shipped within 48 business hours following receipt of the payment, unless stated otherwise on the “Basket” page.
Once our Shipping Department has released your purchase, it will be delivered in 2 to 3 days by Coliposte (colissimo tracking).
Shipping times are expressed as business days, assuming no postal delivery problems.
Shipping times in Rest of World
Your order will be delivered by COLIPOSTE

5.2 Late or no delivery
Package lost in transit
Colissimo is a very reliable service. However, as with any shipment, the package may be delayed or go astray. If a delivery is delayed by more than 7 days, the Customer must notify Chazette-Spirit Customer Service, who will send the information to the Post Office to open a ticket to investigate it. This investigation may take up to 21 days from the time that it is opened. If during that time the package is found, it will be resent immediately to the Customer's home address (in the majority of cases). However, if the package is not found after 21 days of the investigation, Colissimo will regard the package as having been lost. In such a scenario, Chazette-Spirit will send the Customer a replacement at Chazette-Spirit's cost. If the product/s is/are no longer available at the time, Chazette-Spirit will refund to the Customer the cost of those products.
Cancellation of order
If more than 7 days after the promised delivery date the goods have not yet been delivered, Customer may cancel the order by contacting Chazette-Spirit Customer Service by email or phone.

5.3 Anomalies
Any delivery anomalies (item damaged, package open or damaged...) must be stated on the delivery note in the form of “handwritten reserves” along with the Customer's signature. Customer must immediately report the anomaly to Chazette-Spirit Customer Service so that a claim can be made to Coliposte.
Chazette-Spirit will send to the Customer replacement item(s) at Chazette-Spirit's cost.

ARTICLE 6 - RETURNS AND RIGHT OF WITHDRAWAL
Withdrawal terms
Customer has the right within 14 days following the date that the totality of his order is received, to return the goods and withdraw from the agreement without having to give a reason.
To exercise this right of withdrawal, Customer must notify his decision to withdraw his order unambiguously in writing stating his full name, email address, postal address, and number and date of the order:

Refund
If Customer withdraws from the agreement, Chazette-Spirit will refund the payments received from Customer without undue delay and in any case no later than 14 days following the date that Chazette-Spirit was notified by Customer of his decision to withdraw.
If Customer withdraws from his entire order, Chazette-Spirit will refund all the payments received from Customer for that order.
If Customer withdraws from only part of the Products ordered, Chazette-Spirit will refund the amount paid for the Products that have been returned.

The repayment method will be the same as the payment method used by Customer to make the purchase or by bank transfer.
Chazette-Spirit may delay this payment until it has received and inspected the Products.
Return of Products
Customer must return the rejected Products no later than 14 days after communicating his decision to withdraw.
Returned products must be unused, complete and undamaged.

Customer shall bear the cost of returning the Products whether all or part of an order.

ARTICLE 7 - QUALITY GUARANTEE
Customer benefits from a quality guarantee on Chazette-Spirit products.
Chazette-Spirit undertakes, in the event that a fault is found, to exchange or refund of the faulty or non-compliant Products as well as any return costs within 14 days.

ARTICLE 8 - DATA PRIVACY
Personal data has to be collected as part of distance selling, as the information is necessary to be able to process orders, deliver goods, and issue invoices. Such information is strictly confidential and is not disclosed to third parties.
The French Data Privacy Act (“loi Informatique et Libertés") requires that the processing of Customer personal data be reported to the French data protection authority (Commission Nationale de l'Informatique et des Libertés / CNIL) under registration number 1079702.
In accordance with Article 34 of the Act of 6 January 1978, Customer has the right to access, modify, rectify and delete the data relating to him.

Article 9 – DISPUTES
This contract is governed by French law. Chazette’Spirit shall not be held liable for tangible or intangible property damage or personal injury of any kind, that may result from the misuse of the products marketed.
In the event of problems with the application of this contract, Customer may, before entering into any court proceedings, seek an amicable solution with the help of a professional body, a consumer association, or any other counsel of his choice.
Complaints and objections shall always be received with careful attention, with the presumption that the complainant is acting in good faith. In the event of a dispute, Customer shall first contact the company to obtain an amicable solution.
The Commercial Court of Clermont-Ferrand shall have sole competence, regardless of the delivery destination or payment method accepted.
